Legal Objections to Bills S.447 and H.R.1226

1. Bills S.447 and H.R.1226 Violate International Treaty and law The Justice for Uncompensated Survivors Today Act of 2017, S. 447, passed the Senate on December 12, 2017. A related House Bill H.R.1226 was introduced in the US House of Representatives on February 27, 2017. Both S. 447 and H.R. 1226 (the “Bills”) are now before the Committee on Foreign Affairs of the House of Representatives. The texts of the two Bills are similar and in parts identical. The Bills call on “countries of particular concern” relative to the Holocaust Era assets and related issues to: 1) return to the rightful owner any property, including religious or communal property, that was wrongfully seized or transferred; 2) provide property or compensation for heirless property in order to assist needy Holocaust survivors, to support Holocaust education, and for other purposes. >>more...

Owing to the comprehensiveness of this work, my review is limited to certain issues surrounding mostly-recent Jewish-Polish and Jewish-Christian relations. Author Doris L. Bergen is Professor of Holocaust Studies at the University of Toronto. This book is excellent in terms of its relative de-emphasis of Holocaust supremacism. That is, it avoids Holocaustspeak and the mystification of the Holocaust, and it gives nontrivial coverage to the long-neglected non-Jewish victims of the Nazis, notably the Poles. The highlight (or lowlight) of this book is the citation (see p. 254 and 271) of Elisabeth Kübler. 2012. EUROPÄISCHE ERRINERUNGSPOLITIK. (p. 28 in her work). In doing so, author Jacob S. My review is limited to Tomasz Frydel and his chapter: “The ‘Hunt for the Jews’ as a Social Process, 1942-1945”. Once again, Frydel’s work is refreshingly objective. It is a clear contrast to the standard narrative, especially as propounded by neo-Stalinist authors such as Jan T. Gross, Jan Grabowski (especially his JUDENJAGD), and Barbara Engelking. According to the standard narrative, Poles, apart from a handful of enlightened individuals that rescued Jews, were a terrible, primitive people steeped in Catholic-patriotic traditions, making them (what else?) anti-Semitic, and therefore prone to denounce and kill fugitive Jews. Using excellent scholarship, including the use of archival information, Frydel soundly debunks this standard Polonophobic and anti-Catholic nonsense. >>more...
